The Crown is seeking a six-year prison sentence for a man convicted of manslaughter in the death of his grandmother.
It was four years ago this week that Brandon Tobin, in a drug-induced seizure, attacked 82-year-old Mildred Brake on Mitchell Court.
It happened shortly after she arrived home after a Paddy’s Day party where she’d been on the dance floor all night. But that zest for life was violently snuffed out, the autopsy finding she died of blunt force trauma to her chest, caused by stomping or kneeling on her.
Tobin, now 31, was on cocaine and a half dozen other drugs at the time, triggering a known history of seizures, which the Crown noted was both foreseeable and preventable.
In seeking the higher-end sentence, they pointed to Tobin’s past convictions for violent offences, his far-from-model inmate status, and being deemed a very high risk to reoffend.
Brake’s daughter said her mom was the center of her world, with the loss permanently changing her family’s life, leaving a massive void and the knowledge she and her great-grandchildren will never know each other.
The defence, meanwhile, is seeking a three-to-four-year prison term.
Whatever sentenced is handed down, it will be reduced by about two years for time already served.
Sentencing is set for April 30th.
