The Privacy Commissioner is recommending that NL Health Services release information related to the CorCare contract as requested through Access to Information – in part because a lot of the information is already publicly available.
The complainant disagreed with the health authority’s decision to withhold some of the information being sought, by relying on section 39 of the Access to Information and Protection of Privacy Act.
That section deals with the disclosure of information harmful to the business interests of a third party.
The complainant argued that there is a significant public interest in release of the entire contract.
The Privacy Commissioner found that some of information that was being withheld was already publicly available, and because of that, is recommending that NLHS release any information now known to be public within 30 days.
The office is also asking that NLHS reconsider its decision on the remainder of the information by releasing any information it determines does not meet the test for section 39.
